Influsway FZ-LLC (“Influsway”, “we”, “us”, or “our”) respects your privacy and is committed to protecting your personal data. This Privacy Policy (the “Policy”) explains how we collect, use, store, disclose, and safeguard information when you use our website, mobile application, and related services (together, the “Platform”).

This Policy complies with the UAE Federal Data Protection Law (No. 45 of 2021) and, where applicable, the EU General Data Protection Regulation (GDPR).

By accessing or using the Platform, you acknowledge that you have read and understood this Policy.

2.1. Data you provide:

  • Registration details: name, email, phone number, password, date of birth, and social media handles.

  • Payment details: bank account or wallet details (processed via third-party payment providers). Note that Influsway does not store full payment card numbers.

  • Identity & Licensing Documents: Government identification (e.g., Emirates ID, Passport) and regulatory licenses (e.g., NMC permit) for verification purposes.

  • Business details (if you are a brand): company name, trade license, VAT number, billing info.

  • Campaign related information: Deliverables, bids, content submissions, performance metrics.

  • Communication: messages, inquiries, support requests, reviews, and complaints.

2.2. Data we collect automatically:

  • Device info (IP address, browser, operating system, device type).

  • Usage data (time of visit, pages viewed, actions taken, referral source).

  • Log-in and account activity records

2.3. Data from third parties:

  • Social media platforms (if you link accounts): profile data, username, engagement metrics.

  • Payment processors: confirmation of payments and payouts.

  • Fraud-prevention providers: verification or blacklist data.

We process your personal data for the following purposes:

  1. Account setup & management: to create and maintain your Influsway account.

  2. Service delivery: to enable Influencers and Businesses to connect, post campaigns, submit bids, deliver content, and complete payments.

  3. Payments & fees: to process payments, calculate commissions, and issue payouts via third-party providers.

  4. Verification & compliance: to verify identities, comply with anti-fraud and anti-money laundering obligations.

  5. Analytics & improvements: to monitor performance, enhance features, and improve Platform security.

  6. Marketing: to send you updates, offers, or newsletters, subject to your consent where required.

  7. Legal obligations: to comply with UAE law, EU GDPR (if applicable), and other international data protection requirements.

  8. Dispute resolution: to manage complaints, investigate violations, and enforce our Terms.

  1. LEGAL BASES FOR PROCESSING

We rely on the following lawful bases under GDPR and UAE law:

  1. Performance of a contract (to provide services you requested).

  2. Consent (for optional marketing and when linking social media accounts).

  3. Legal obligation (to comply with tax, anti-money laundering, and regulatory requirements).

  4. Legitimate interests (to improve services, prevent fraud, and secure our systems).

  1. CONSEQUENCES OF REFUSAL

    1. If a User refuses to provide required Personal Data, Influsway may be unable to provide services, process payments, or allow Campaign participation.

  2. THIRD-PARTY LINKS

    1. The Platform may contain links to third-party sites. We are not responsible for their privacy practices. Users should review third-party policies separately.

  3. COOKIES AND TRACKING TECHNOLOGIES

    1. We use cookies, tracking pixels, SDKs, and similar technologies to:

      1. authenticate Users;

      2. remember preferences;

      3. measure Campaign performance;

      4. provide targeted advertising.

    2. Users may disable cookies in their browser settings, but this may affect Platform functionality.

  4. DATA STORAGE & SECURITY

    1. Your data is stored on secure servers located in the UAE and/or the European Economic Area (EEA).

    2. We implement organizational and technical measures (encryption, access controls, firewalls) to protect your data from unauthorized access, loss, or misuse.

    3. Access to your personal data is restricted to authorized employees, contractors, and service providers.

    4. In the event of a Personal Data breach likely to result in a high risk to Users, we shall notify affected Users without undue delay and, where required, notify regulators.

  5. DATA SHARING

    1. We may share your personal data with:

      1. Businesses and Influencers you engage with via the Platform.

      2. Payment processors (specifically Stripe) for transaction processing, fraud prevention, and identity verification (KYC) requirements.

      3. Service providers (hosting, analytics, customer support, marketing).

      4. Regulatory or legal authorities where required by law.

      5. Third-party partners where you have given consent (e.g. linked social media).

    2. All third parties are bound by contractual and legal obligations to safeguard your data.

  6. AUTOMATED DECISION-MAKING AND PROFILING

    1. Influsway may use automated tools to:

      1. recommend Influencers to Businesses;

      2. assess Influencer performance and engagement quality;

      3. detect fraudulent activity.

    2. Users have the right to request human intervention and to contest any automated decision.

  7. INDEPENDENT RESPONSIBILITY OF BUSINESSES AND INFLUENCERS

    1. Once Personal Data is shared with a Business or Influencer through the Platform for the purposes of a Campaign, such party becomes an independent controller of that data. Influsway is not responsible or liable for how Businesses or Influencers process, use, or safeguard Personal Data once it has been disclosed to them. Users should review the privacy practices of such parties directly, as Influsway does not control their data handling.

  8. INTERNATIONAL TRANSFERS

    1. Personal Data may be transferred to and processed in countries outside the UAE, including the EU and the United States.

    2. Where such transfers occur, we implement appropriate safeguards such as Standard Contractual Clauses (SCCs) or equivalent.

  9. DATA RETENTION

    1. Account data: kept while you maintain an account, then deleted or anonymized within 12 months after closure.

    2. Transaction data: Payment and transaction data may be retained for seven (7) years in accordance with UAE tax and accounting laws.

    3. Marketing data: retained for as long as necessary or until you unsubscribe or withdraw consent.

    4. Influencer Deliverables and Campaign data stored in the Content Bank may be retained for up to five (5) years for dispute resolution, compliance, and record-keeping.

  10. MARKETING COMMUNICATIONS

    1. We may send marketing emails, notifications, or SMS about Platform features or offers.

    2. Users may opt-out at any time via unsubscribe links or account settings.

  11. YOUR RIGHTS

You have the right to:

  1. Access your personal data.

  2. Rectify inaccurate or incomplete data.

  3. Erase your data (“right to be forgotten”), subject to legal limits.

  4. Restrict processing under certain conditions.

  5. Data portability in a structured, machine-readable format.

  6. Object to processing (e.g. marketing communications).

  7. Withdraw consent at any time.

  8. Not be subject to automated decisions that significantly affect you.

  9. File a complaint with the UAE Data Office or your local supervisory authority in the EU.

  10. To exercise rights, Users must email. Influsway may request proof of identity.

  11. Requests will be processed within thirty (30) days, subject to lawful extensions.

    1. We may update this Policy from time to time. Updates will be posted on our website and app, with the “Last Updated” date changed accordingly. Continued use of the Platform after changes indicates acceptance.
